The trial of Sambo Dasuki, former national security adviser (NSA), at an Abuja high court did not commence ‎on Thursday owing to the inability of the federal government to make him available.
Dasuki is facing 22-count charges of money laundering and criminal breach of trust brought against him by the Economic and Financial Crimes Commission (EFCC).
Over the course of his trial, the government has failed to bring him to court not less than five times.
The government had failed to bring him to court twice before Adeniyi Ademola of the federal high court, Abuja, once before Hussein Baba-Yusuf of the federal capital territory (FCT) high court, and twice before Peter Affen of the FCT high court.
All the courts where the government filed charges against him granted him bail, but he was re-arrested and kept in the custody of the Department of the State Services (DSS).
As the case was called on Thursday, Rotimi Jacob, counsel to the EFCC, told the judge he was surprised that Dasuki was not in court.
He explained that he had notified the EFCC on the need to bring Dasuki to court, but that he regretted the communication gap between the EFCC and the DSS was responsible for the absence of the accused person in court.
In response, Joseph Daodu (SAN), Dasuki’s counsel, said it was sad that the government which put his client on trial was now scuttling it.
Daodu said that from June when the case was adjourned to Thursday, the EFCC ought to have known that it was its responsibility to bring Dasuki to court.
After listening to the counsel, Affen, the judge, counselled the government to ensure that Dasuki is brought to court whenever his case is scheduled to hold.
He then adjourned the matter to October 21.

Former National Security Adviser, NSA, Col. Mohammed Sambo Dasuki (retd), has dragged the Federal Government before the ECOWAS Court in Abuja.
Sambo Dasuki is seeking the court’s order for his release. He is also demanding payment of N500 million damages for alleged infringement on his human rights. In the suit filed by his lawyer, Robert Emukpoeruo, Sambo Dasuki urged the court to declare among others, that his continued detention was in defiance of court orders for his bail, and an abuse of his fundamental human right.
He also prayed the court to hold that it was, “a most egregious violation of the treaty obligations” signed by Nigeria to have unlawfully detained him under a “de-humanizing condition” after he had been granted bail and met the conditions for his release.
The applicant further asked the court to declare that the alleged invasion of his home in Abuja and Sokoto on July 16 and 17, 2015 and the “forceful and unlawful seizure” of his properties, “without any lawful order or warrant” violates his fundamental rights and offended the country’s treaty obligations as a signatory to the listed legal instruments.
One of the lead lawyers to former National Security Adviser (NSA), Col Sambo Dasuki (rtd) , Mr Ahmed Raji (SAN) has disclosed that his client has met the terms of his bail condition.
He however added that Dasuki is yet to be released from Kuje Prison on the grounds of a certain document for his release.
Raji, who stated this during an interview with LEADERSHIP last night, added that the legal team was unable to secure the document for Dasuki’s release from Justice Peter Affen of an Abuja High Court.
The senior advocate further claimed that his client had met the bail conditions at about 4pm yesterday.
He said, “He (Dasuki) has been able to meet all the bail conditions after he was granted bail by the court. The only thing we are yet to get is the signature of the judge for his release”.
The former NSA may spend the Christmas in custody if he is unable to get the judge to sign the document for his release.
Dasuki and four others are standing trial for alleged money laundering and criminal breach of trust over alleged diversions of the money recovered from the Abacha loot which was meant to purchase arms to fight Boko Haram terrorists.
Others standing trial with him include a former director of finance at the office of the NSA, Shuaibu Salisu, a former Group General Manager of the Nigerian National Petroleum Corporation, Aminu Baba Kusa and two firms, Acacia Holdings Limited and Reliance Reference Hospital.
Dasuki and others were granted bail in the sum of N250million each and a surety each who must be a serving or retired civil servant not lower than the rank of a director.
The defendants were also asked to deposit their international passports with the court registrar. They are also to notify the court of any travel arrangement outside the FCT.
